Terms of Service

1. Who we are
Team Forman Experience (“TFX”) is operated by The Jane Forman Tennis Academy INC, a Florida corporation (“the Company,” “we,” “us”). The corporate name is the legal entity behind the club; the club itself is TFX. These Terms of Service (“Terms”) govern your use of our websites, the TFX members community, our coaching content, and our in-person programs such as mini-camps (together, the “Services”). By creating an account, purchasing a membership, booking a program, or otherwise using the Services, you agree to these Terms.
2. Eligibility and accounts
You must be at least 18 years old to create an account or make a purchase. A parent or legal guardian may register and manage participation for a minor in an in-person program. You are responsible for your account credentials and for all activity under your account, and you agree that the information you give us is accurate and kept up to date.
3. Memberships and billing
TFX memberships are paid subscriptions billed in advance on a recurring basis at the price shown at checkout, plus any applicable taxes. Payments are processed by our payment provider; we do not store your card details. Your subscription renews automatically until you cancel. You can cancel at any time, cancellation takes effect at the end of the current billing period, and amounts already paid are not refunded except where these Terms or applicable law require otherwise. We may change membership pricing with notice; the new price applies from your next renewal.
4. Mini-camps and in-person programs
In-person programs are scheduled individually and may require a deposit to hold your dates. Deposits, balances, and any program-specific cancellation or rescheduling terms are stated when you book, and those terms control for that program. If we cancel a program and cannot reschedule it with you, we will refund what you paid for it.
5. Assumption of risk
Tennis is a physical activity. Participation in any in-person program, and any decision to follow training, drills, or technique guidance from our content, carries an inherent risk of injury. You confirm that you (or the participant you register) are physically able to participate, and you assume the risks ordinarily associated with athletic activity. Our content is coaching instruction, not medical advice; consult a physician before beginning a training program if you have any doubt.
6. Our content
The Services and their content, including coaching videos, the Playbook library, text, graphics, logos, and the TFX and Team Forman brands, belong to the Company or its licensors and are protected by intellectual property law. Your membership grants you a personal, non-transferable right to view that content while your membership is active. You may not copy, download, redistribute, resell, publicly screen, or share access to it, and you may not share your login.
7. Your content
You keep ownership of what you post in the community, including messages, images, and video clips. By posting, you grant the Company a non-exclusive, worldwide, royalty-free license to host, display, and reproduce that content as needed to operate and promote the Services. You are responsible for what you post and must have the rights to post it.
8. Community conduct
The community is a coached club, and we moderate it as one. Do not post anything unlawful, harassing, hateful, sexually explicit, or deceptive; do not spam, solicit, or scrape; do not upload content you lack rights to; and do not interfere with the Services or attempt to access accounts or systems that are not yours. We may remove content and suspend or ban accounts that break these rules, with or without notice.
9. Termination
You may stop using the Services or cancel your membership at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Services. Sections that by their nature should survive termination, including content licenses, disclaimers, and limits of liability, survive it.
10. Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, the Company disclaims all warranties, express or implied, including fitness for a particular purpose, and does not warrant that the Services will be uninterrupted, error-free, or that training results will meet your expectations.
11. Limitation of liability
To the fullest extent permitted by law, the Company will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services. Our total liability for any claim arising out of the Services is limited to the greater of one hundred US dollars or the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Changes to the Services and these Terms
We may change, add to, or retire parts of the Services. We may also update these Terms; if a change is material we will give notice, such as by email or an in-app notice, before it takes effect. Continuing to use the Services after a change takes effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute that is not resolved informally will be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.
